Just behind Coy was Charles Belvin. As Coy was walking toward the family, Charles shot him in back. Thinking Coy was dead, Charles turned way, but Coy emptied his gun into Charles. Coy died right there but Charles lasted for a few days. His being listed first even though the youngest also supports this possibility. Since the census reports Milton born in Oct 1887, this would seem to mean that Cynthia died probably in 1886, after which George married Lizzie and Milton was born in late 1887. However, note that Lizzie's record reports that she has been married only 3 years. All the children reported in this census would be Cyntha's children. Should this report have said married 13 years? Notice that it says George was married 14 years, and there is a 2 above that, indicating the second marriage? But the number of years should be the same. These people certainly were not obsessed with the precision drilled into us by our modernistic schools focusing on detail and precision analysis. On balance from this uncertain information in the census, it appears that Cynthia died after October 1887, when their son Milton was born Her death could still have occurred as early as 13 years before the 1900 census, when her husband George and her children are all still in Chickasaw Nation, as are other Green family members and relatives. Going by the record here for Lizzie, we will say that George and Lizzie married about 1897. It is reported that her daughter Elzie's death certificate says that Cynthia was born in Texas, but the first census for this family in 1860 reported 3-year-old Cynthia as born in Georgia, which I believe to be correct. Family tradition and census records indicate all the children had been born before Toliver moved his family west.

It is not clear how this Daniel Green is kin to other Greens in our information. Some indicate he is the brother of Toliver Green, and the ages would put them in the same generation. At least one genealogy does list a Daniel Green among the siblings of Toliver, but this old genealogy has no footnotes or source info. Genealogies are incomplete and uncertain, and we continue reviewing the details as more comes to light. I have not entered this Daniel Green into the family relationships of Toliver and siblings and their father, who appears to be Daniel John Green. Some genealogists in our family accept the link and assign Daniel Green as Daniel, the brother of Toliver. He also matches the son of Ancil Cunningham Green and his wife Sarah L Bearden. Most genealogies of the families that have the siblings of Toliver Green lack a Daniel. There is some indication in some documents, however, that Toliver did have a brother named Daniel. A strong negative factor is that he is not mentioned in the will settlement, which mentions an amount of $77 for several sons or sons-in-law. But the list in the will does not include a son named Daniel. Also uncertain is the name Ansell Wright Green of a similar age as Daniel. The apparent son, maybe a nephew, of Talitha Bearden and her husband in the 1850 and 1860 censuses is Ansell Wright (Tunnel Hill Township, Gilmer County, Georgia). But some sources also have the same name for his father. Precious little documentation is existent at all. At least one source has reported that Daniel and the older Ansell Wright Green are the same person, with the name Ansell Wright Daniel Green. This seems too great a stretch for the thin information we have and the counter-indications. Also the name Wright is definitely entered as a last name for Ansell, not a middle name. It is also uncertain where the name Wright would have come in for a Daniel in the line of our Greens, since there seems to be no Wright married into the Green line. It would appear that Wright as a middle name retains some previous maiden name, but I have not been able to find it. It could be from the Bearden side. An older Ansell Green, without the middle name Wright, also appears in a previous generation in other genealogies of this same Green lineage. Ansel was not born until Talitha was about 28 years old. That would be in 1837. So he may not be their child. But if he is their child, either Ansel is their first child or their last, or -- unlikely -- their only. But if he is the first child, then where are the others? He is 13 years old. But if the last, there should also be a couple of others still at home, unless there is a very big gap since the last one. Either way, it does not seem to leave room for a different father. Since he has a different last name, he could be a nephew. But no relationship has been found to a Wright family. It is taken by some genealogists that his name was Ansell Wright Green. But see the 1860 census, where he is still Ansell Wright, and apparently married with his wife named Mary Wright. In 1854, Both Daniel and Talitha assisted a relative, William Flanagan, by serving as witnesses in William's heirs in their application for his military pension. William Flanagan was the father of Winifred (Winny or Winna) Flanagan Bearden, wife of Jacob Newton Bearden. Jacob Bearden was a deponent in this case. The affidavits state that Winna Bearden and Priscilla Flanegan are the two surviving children of William and his wife Sarah Self Flanegan. William had been a pensioner of the United States in Hall County, Georgia, before his death on 15 September 1845 and his wife Sarah after that until her death in Gilmer County, Georgia, on 26 June 1848. These depositions on behalf of their daughters were made in May 1854. Daniel, his father and his uncle Abraham Jackson served in the Texas State Troops and Confederate States army. Daniel was in the TST initially, then was mustered out so he could reenlist in the regular CSA, still in an assignment for defense of the frontier, according to his muster roll card. But no one had any further details on place or tribe. In October 2007 I found a genealogy with information on what appeared to be our Daniel David Green, married to Frances Colbert. Dave (also went by Daniel or Dan) lived in Love County, Oklahoma, where other members of the Green-Jackson families lived, and Daniel Green is listed in the burial information for Lakeview Cemetery, Love County, Oklahoma. The genealogy gives no commentary of information about Frances' family ethnicity. Her parents are not listed. Dan and his Chickasaw wife Fannie, and their family, were known to current (2015-2017) members of the Green-Gresogry-Jenkins famliy in Oklahoma and Texas. We learned details of their contacts and permanent residence in Chickaasaw Nation through the reseaarch of Kati Jackson Cain, researching Chickasaw Nation records in October 2015. "I have found permits for "T. Green" and his license is issued under Francis (Colbert) Cochran, now we also know how Daniel Green and Francis Colbert met. There's also a permit for a William Jackson. As farmer. Given under my hand, this day and date above written. Wm P Worthington District Clerk" A few months later, Frances Cichran married Toliver Green';s son Daniel Green. This establishes the proximity of the Green family. They actually lived just over the ed River from the area of Pickens County, Chickasaw Nation, where Frances lived. This T Green could be Daniel and Jackson's father Toliver Green. It could also be Tom Green, now known as another name for Jackson Green. The name Tom Green also appears with Dan Green and Abraham Jackson, husband of their sister Talitha Green, and is otherwise unidentified in family information. The trio is referred toether in several illegal exploits, so must have been regular cronies. One such legal document from that era clarifies who this Tom Green was. Another court record found in the Ft Smith/Van Buren records of the Westeren District of Arkansas identified charges against Dan Green and Jackson Green, aka Tom Green, The warrant noted that charges were originally filed against them as Dan Green and Tom Green. This would iinform us that Dan and Talitha's brother Jackson was named either Thomas Jackson Green or Jackson Thomas Green. Both these names are found in the family lineage. There is a pattern in this line of using the middle name as the common name, so it seems likley Jackson was his middle name. We are lisitng him in this genealogy as Thomas Jackson Green. During the 1870s, Dan is documented in legal documents of the Western District of Arkansas, the US jurisdiction for US citizens living in Indian Territory, administrered form Ft Smith and Van Buren, Arkansas. The court records are found with names of Abraham Jackson and related Greens, Jacob, Daniel and Jack, in the Ft Smith, Arkansas area. In one of these Dan and his brother Jack (Jackson) are charged with assault with intent to kill; in the U S Federal Court for the Western District of Arkansas, which handled judicial matters for U S citizens in the Indian Territory. There are a couple of other trespasses, included cattle rustling, but disposition of these case is not there. Writ for Bond to Appear date moved due to non-arrival of defense witness and illness of prosecution witness. Bond of $1000 set to ensure appearance at next court session 10 May 1875 -------------- United States of America Western District of Arkansas United States vs Daniel Green and Jackson Green charged as "Dan Green and Jack Green" Assault with intent to kill 6 April 1875 "Came the defendants in custody of the marshal and the witnesses for the government not having arrived, the prosecuting witness being sick, the defendants waive an examination of the charge, to which the District Attorney assents." Wherefore the defts. [defendants] were required to give a joint bond in the amount of one thousand dollars for their appearance on the 1st day of the next May term to wit May 10th 1875" -------------- No documentation of the final trial has been found. Dan's brother-in-law Abraham Jackson is also documented in these court records. Abraham (Abe) had been in Indian Territory in the Civil War. Military records seem to refer to our Abraham Jackson, in the Scanland Squadron, Texas Company A. This was part of the Wells Regiment. They were stationed in Ft Arbuckle, Oklahoma. The Jacksons later lived not far south of there, in the Ardmore and Marietta areas. This Squadron was active in CSA operations in northeastern Oklahoma and Northwestern Arkansas. The latter location would also link Dan, Abe and Dan's brothers Jacob and Jackson to that area, where all four are named in court records on various causes in the US Court for the Western District of Arkansas, which handled judicial matters for U S citizens in Indian Territory. There was no census for Indian Territory residents in 1870, so there is a gap in our knowledge of the location of homesteaads. Daniel married Frances on 8 October 1871, according to the Sherman genealogy. He died in 1878, so we will not have any census documentation of their marriage or family. Frances went by Fannie. Chickasaw History reports this date. This entry is found under Frances' record. "She married Daniel Green in Berwyn, Pickens Co., Chick Nation, IT, 8 OCT 1871.(1702) (Daniel Green is #26909.) Daniel was born circa 1848.(1703) Daniel died before 1879. Marriage records show his name as "David" but Dawes records for his son give it as 'Daniel'." -- Chickasaw History, Francis Colbert, http://www.chickasawhistory.com/colbert/i0026899.htm#i29612b In the 7 years of their marriage, Daniel and Frances had three children that are recorded by the Sherman genealogy. There was one girl named Minnie Lee Green, and two boys. Another genealogy of the family records only Minnie Lee. I later found a 1900 census record for Fannie as a widow with two of her children, reporting them all as Choctaw Indians, living in Chickasaw Nation. Her son living next door to them is also reported as Choctaw. This is probably due to their original registration in Choctaw Nation where they living at the time of the first Indian roll registration. Originally, also, the Chickasaw and Choctaw shared an allotment area, which was later separated for each tribe. (See Notes for Frances Colbert.) There were three additional children who died as infants. The names of the boys are unusual, and the two sons have names that are forms of the same name: Reddick "Redie" Green and Daniel Redric Green. The second son's middle name Redric looks like a variation of the first name of the first son's name Reddick. In May 2008 I found a 1900 census record for Reddick J Green, of an age matching the oldest son. This census reported Reddick, his wife Etta and their two children as White. I could not find any census record confirming the existence of the child reported in the genealogy as Daniel Redric. The name Redric looked like an error or a variation for Reddick, his older brother's name. I have found no documentation of a middle name of Redric that some of the genealogies have. But in 1900 he is in his widowed mother's household as Dan Green. In September 2010, I found some census entries that appeared to match this reported child Daniel. The 1910 and 1930 censuses report him, however, as Daniel G. The Chickasaw History reports the second son as simply Daniel: "Daniel Green (#26910) was born in IT circa 1874. Daniel enrolled in Marietta, Pickens Co., Chickasaw Nation, IT for the Dawes Chickasaw Roll on 3 OCT 1898 and appears on Dawes card number 1615.(1716)" -- Chickasaw History, Francis Colbert, http://www.chickasawhistory.com/colbert/i0026899.htm#i26899 Daniel was Fannie's second husband. Her first husband, Samuel Hunter Cochran, who died at an unknown time before Fannie's marriage to Dan in 1871. She also had a third husband, Charles Adams, who died sometime before 1888, when she married her fourth husband, Theophilus H East. The 1900 census record for 1900 showing her as a widow named Francis East. But this appears to be a social fiction, because thery were divorced. Theophilus testified in his 1904 interview with the Dawes Commission in regard to his citizenship in the Chickasaw Nation that Fannie had left him and they divorced in about 1892 in Canadian County, Oklahoma Territory. The transcript reports that he provided papers, but they were not included in the transcription. The Colbert family genealogy I found with all this great information reported that Theophilus and Fannie died the same year, 1910. But death reccords report that Theoplhilus died in 1917 in Colorado, from complications during surgery. Daniel David Green went by Dave. His uncle Daniel David went by Daniel or Dan. All Daniel David's nieces call him Uncle Dave. I found an entry in the 1900 census that appears to be our Daniel David Green. He is a single young man of 16, living with and working for a related Thompson family in Chickasaw Nation, Indian Territory. Head of household John W Thompson is white, with two white parents, but his wife and children are reported as Choctaw. This Minnie Lee Thompson is Dave's Father's first cousin, the daughter of Daniel David Green (b 1844) and Frances Colbert. The elder Daniel David is the brother of Jackson Green, father of the younger Daniel David (b 1882). Minnie Thompson is Daniel D's first cousin. Another anomaly is that his age had originally been entered as 17, which would be right for a May 1883 birth date, at this June census. But it was crossed out and changed to 16. A birth date in May 1882 would mean an age of 18. So the birth date and age are not definitive. Lack of birth place for parents also leaves out another good cross-check on identity. Dave married Frances (Fannie) Briscoe. In the 1910 census, Dave and Fannie have just gotten married, recorded as married "0 years." In this census Dave is listed as Dave D. Other members of the family have switched the order of names also to put the preferred name first, even if it was the second name. In 1900 she had been recorded as Fannie D. Both Dave's parents are reported here as born in Tennessee. This is odd, since we have birth information for them. Jackson was born in Georgia before the family moved to Texas. Census information in 1920 and 1930 both report Clarinda's birthplace as Illinois. Parental birth places differ also for Fannie, whose father is said to have been born in Georgia. But the 1900 census said he was born in Texas. Her mother is still reported born in Alabama. Dave's niece Loretta Gregory Gay reports that Fait told her that when he was in school, he used to ride a horse from the St York Indian Baptist Church east of town to school in Marlow. Most genealogies of this family lack this person. He appears under the name Daniel Redric Green in only in a few genealogies, and they do not document this person from other sources. Note that this middle name appears to be a form of the first name of Fannie and Daniel David's first son Reddick (Redie) Jackson Green. In several sources he is David G Green, but no source has been found to explain what name the G stands for. No son named Daniel is reported by the well-documented and detailed Chickasaw History I cite in this genealogy for many details of the Colbert Chickasaw family. I do not find any Daniel Redric in any censuses. I have listed the person as Daniel G Green, based on documentation I discovered in September 2010. (See further notes below.) Birth in genealogies reporting two brothers, birth dates are for Reddick Jackson as about 1869 and for Daniel Redric as 1 April 1872. The Chickasaw history reports a birth date for Reddick Jackson as about 1871. The 1900 census reports Reddick's birthday as February 1869. One genealogy (Powell family of Reddick's daughter Myrtle Emma Green Powell) reports Reddick's birth as in 1872, matching the year reported by a couple of others for the child named Daniel. This matches our Daniel G Green, who did indeed marry Sarah F Powell. Reddick appears to be the older and is reported in some sources to have been born in 1869 (before his parents' marriage). The date of birth on Reddick's grave, however, is 7 Feb 1872. But this conflicts with Daniel's reported birth in April 1872. There is another conflict, since the reported marriage of Reddick's parents was in October 1871. They may have been married in a Chickasaw ceremony earlier. The Powell genealogy reports a Julius (Andrew Julius Powell) as the husband of Reddick's sister Myrtle. They had one son named Daniel Redrek Powell. One is a postal registered letter receipt dated in May 1907. In November that year, Indian Territory became part of the new State of Oklahoma. It was sent from Muskogee, Indian Territory (seat of the Creek Nation with a large white settlement. He received it at the Marietta, Indian Territory, Post Office. This is near the Texas border. Marietta is in what became Love County, Oklahoma. The 1910 and 1930 census has David G, indicating a different name from that of Redric reported by the series of undocumented genealogies that appear to be copying each other. Some of these also have mixed various random records for other individuals with the name Green so that they report various members of our family dying in Maine. One of these careless coompilaitons even reports this Daniel as born in Maine! It is ludicrous to think that any of our Green family was ever in Maine. I wrote two or three times to the compiler of the first such genealogy, and never received an acknowledgment. In the 1910 census, Daniel and Sarah are in Washington Township of Love County, Oklahoma, the right place for this family. Both Daniel (D G) and his wife Sarah are reported as White. But in 1930, Daniel is an Indian, as well as his son. Interestingly also, this is reported as the second marriage for both Daniel and Sarah. To confirm the identity of the family, we find Sarah Powell's parents in the household. A typical variation in census ages. By the 1930 census, they are living in farther east in McCurtain County, near Broken Bow, in the Washita Mountains. His father is Mixed Blood and his mother Chickasaw (in place of a place of birth). This is the first report I have seen that reports Daniel David Green as part Indian. This would mean that Talitha and Jackson and other siblings also passed on their Chickasaw blood, but I have not heard or seen any family evidence or records of this. What we know indicates the Green lineage comes from Cherokee. But they did not overtly maintain this identity; this was not part of the common family oral history. I think this is an enumerator error. My research indicated that farther back we have Eastern Cherokee in the Green line, from Meshack's wife Lucretia, and possibly other Green sources. This is uncertain. But in the 1850 and 1960 censuses where I had records for Daniel David, race was not reported. Daniel David Green died in 1878, and I have found no census for this family in 1870. No censuses were taken in Indian Territory until 1890 for Oklahoma Territory and 1900 for Indian Territory. In December 2012 I found the 1940 census for Daniel's niece Myrtle Emma Green and her husband Andrew J Powell. In their household is reported a Daniel Green, age 72 (born about 1868). We would expect Daniel to be about 68 years old in 1940. The age of 72 matches Daniel's older brother, Myrtle's father Reddick Jackson Green, but he is reported as Andy Powell's brother-in-law. Some old genealogies report Daniel as a brother of Toliver Green, rather than his father. Those sources do not have a birth date for Daniel. In one anonymous genealogy and in the 1850 census, I found his birth year to be "about 1781." This means there is a 31 year difference in their ages, which seems a wide spread. There is only an 11-year spread from the next child (first child in sources I have used) to Toliver, the last child. The sketchy information in genealogies indicated that Daniel John was born in South Carolina and died in Hall County, Georgia. I found Daniel with his wife M, the only name for her in most sources I had found, living in Hall County, next to their son Isaac and his family. I found one genealogy that reported her name as Polly, a common nickname for Mary, matching the initial M all other sources have. A descendant, Gary Cruce confirmed from his family information that her name was indeed Mary. No maiden name is reported by Gary, however. "The (M) stands for Mary. I have my great grandmother's supplemental application. Her name was Fannie Bryant Bruce. Her father was Hardy Bryant. Hardy's mom was Fannie Green, daughter of Daniel Green & Mary Green. There was the name Mashack in the old Green Bible, said William Bryant, brother of Hardy Bryant. They were rejected on their Cherokee blood, but I know they were Cherokee. In light of the meager evidence we have. I report the name as Mary. Two genealogies report her maiden name as Pittman, but provide no documentation. I have found no record of their marriage or of her name in other instances. There was one Polly Pittman who married a certain John Green in 1819, but this was in Craven County, North Carolina, on the Atlantic coast of North Carolina. This is the wrong state and the wrong part of that state to be South Carolina residences marrying there. There was an older Daniel John Greene reported as serving on a jury in St Helena, Beaufort District, South Carolina, in 1793. There are several lines of Greens, and I have not confirmed any relationship of this John Daniel Green or the Daniel John Greene in Beaufort, South Carolina, to the line of Greens being followed here in this genealogy. The similarity of names could indicate familial relationship, or a confusion of generations that reports Daniel John the son of Meshack and Creasy Green. This genealogy is anonymous, but contains much documentation and detail. The will of Daniel (see below) names Toliver as a son and names (some of) the known siblings of Toliver. Toliver likewise is named for a portion of the estate. This seems definitive that Daniel Green was Toliver's father. Several genealogies also report the father of Toliver and his siblings as Daniel. The name of Daniel's wife is known only by an initial M, and no maiden name is known. The most consistent early information I have found in a few sources indicates that Daniel's father is Meshack W Green. Working for years, I have not found out what Meshack's middle initial stood for. According to some family genealogies, Daniel's full name is Daniel John Green. There is also another son of Meshack and Lucretia reported in other genealogies as John, and among sources that have death dates, I have found the same death date reported for both in different sources. Information is inconsistent, and many genealogies give no sourcing information. So John, Daniel and Daniel John may be the same person, but the wives and children for each of these entries are different. So the mystery remains. Various genealogy testimonies and family references indicate it is Mary. I have not found a match in any other source for C Green. Ancestry transcribes the third person as F Green. Though to me it looks more like T Green, the age matches Dan's sister Francy, born about 1785. This individual is a female, 65 years old. Family genealogies do not have any firm info on Francy. But she is in the list provided by Glenda Pool, whose early information has been very helpful. Other family info might place her birth date closer to 1780. If this is Francy, it would mean she did not marry. I have not found any reports of her with a husband. I have found the name Anselem or Anselom Green in some sources as a son of Shadrack, who is a son of William and a brother of Meshack Green. This makes Shadrack a cousin of Toliver and his son Anselem a second cousin. Dates of birth in these generations are uncertain, with sources varying widely, and dates in the same source conflicting, such as marriage dates in the same year as the birth of one spouse, or birth dates matching a previous generation rather than siblings. Glenda Pool reports the following land transaction. Daniel John Green mentioned here appears to be the father of Toliver and son of Meshack. Theodore Thomas Jackson is said to be the father of Mary Jackson who married Toliver's brother, Daniel John's son Thomas Perry Green, who later moved to Saline County, Arkansas. Scott Davis, Jr. Gen. 929.37588 (Dav) ....Part 2, P. 1 I continue to look for further information to clarify the ancestry of Daniel (John) Green, and the origins and family relationships of an Ansel Wright, reported by some as the first husband of a Telitha Bearden, sister of Winnie Bearden. This same Telitha is said to have married a Daniel Green, who may be a brother of Toliver, after Ansel's death. It seems likely there was a Daniel in the earlier generation before Toliver's father Daniel, and likely cousins in the line named Daniel. Different sources have different lists of children, so a Daniel may be missing from the information I have. Right now I have no independent information that supports the suggestion that Toliver's father was named Ansel. The most consistent information and most coherent in sources is that the father of Toliver is Daniel, son of Meshack. One source says that the name of Meshack's father was William, and William's father was either William or Thomas, but no mother's name is known. I cannot find a William or Thomas Green with the expected children's or grandchildren's names associated with them. Other evidence supports the likelihood that Meshack's father, Daniel John's grandfather, was named Isaac. Isaac's father was named John.

David Howell Green and his wife Nancy Hamrick are ancestors of Earl Scruggs, the famous mountain music (bluegrass) musician. There are some differences in the death dates reported. Some sources report he lived his whole life in Cleveland County (formerly Rutherford County), North Carolina. Others report he died in Virginia. The latter may be due to a confusion of two similar individuals. A date for death is 1822. Some sources report he moved to Virgina and died there in 1863. The Hamrick Family Data pages report he died on 28 July 1863, in Mt Jackson, Shenandoah County, Virginia. It is possible that there are two persons confused here in the entry for David Howell Green or David Hamrick Green. I have been unable to find any independent information, however, that confirms a separate person named David Hamrick Green. Some sources say David Hamrick and some say David Howell. The 1860 census reports a David H Green married to Nancy Green.
