Notes for Hannah HORTON

Hannah Horton's parentage was not reported in any of the Terry related
genealogies reporting her as the wife of Miles Terry, son of William Terry, or
Botetourt County, Virginia. I found one or maybe two genealogies that report
her parents. It seemed likely that she was part of the Horton clan related to
the Meshack Green line in our genealogy. All signs point to Meshack and his
wife Lucretia Franklin were Cherokee. But initial investigations suggest it
is a different Horton line.

One of the daughters of Meshack W Green, Nancy Anne, married John (Brissel)
Horton. These Hortons were from Pennsylvania, where they had been Quakers,
and they were attached to the same New Garden Annual Meeting of Friends in
Guilford County, North Carolina, that is reported among members of this Terry
clan.

John Horton, husband of Nancy Anne Green, daughter of Meshack W Green, was one
of the signatories of the original 1817 treaty of the Cherokees with the US
government to ceded their lands in North and South Carolina in exchange for
lands in the west.

Meshack's first wife, whose name is not known, was the mother of Nancy Anne
Green who married John Horton. Since John was white, he would have been
signing the treaty on of Nancy as Cherokee. Nancy being accepted as Cherokee
indicates her mother likely was also, since tribal membership was generally
matrilineal. John and Nancy moved west with the first Cherokee removal and
settled and died in Missouri.

-----------------------
I am the great-granddaughter of Mary Jane Terry Jett 1877-1897. Her family
goes back to parents Miles and Luraney Johnson Terry, grandparents Isaac and
Barbara Gabbard Terry, and then great-grandparents Thomas Miles Terry
1797-1852 who was married to Martha Jane or Patsy Johnson in Breathitt County.
This Thomas Miles was child of Miles B. or Devil Jet and Hannah Horton.
Siblings were Rachel, Annie, Leonard, and Susanna Elizabeth.

It is the story that this Thomas Miles left Patsy and children and took off
and remarried and had a different family up in Floyd County. I was just
trying to be sure I had right person. I was also wondering about the name
Devil Jett as I am a Jett but not sure why or what Devil Jett means. No
insult but my Grandmother said we were not that old bad Curt Jett's bunch and
I know she meant the feuding and killing Curtis Jett. I do not think he was
related (well, not any more closely than us) to Devil Jet.

Hannah Horton

A Rumor is that Hannah's mother is to have been of Cherokee Indian descent. To
date no proof can be found on this statement, but their daughter Annie Terry
married a "Casebolt" and their son latter applied for a government payment as
reparations to the Cherokee Indians in early 1900's.

See information under Annie Terry Casebolt (Miles Terry). This claim was
denied but also serves to substantiate other rumors that Hannah was from
Indian bloodlines. Given the temperament and resentment for Indians in that
day, it would make sense why Miles would move from an area that is still
historically a Terry basin of Roanoke VA.

The following claims further add credence to the Indian bloodline.

Lane Shannon Branham, a grandson on Cornelius and Annie Terry Estep, replied
to correspondence regarding his Eastern Cherokee Application No. 31011, dated
July 25, 1907, under the 1835-1836 and 1846 treaties, as transcribed below
Application No. 31011
Pound Gap WV 6/5/1908

-----------
To Hon. Guion Miller
Special Commission Court Claims
Washington DC

Dear Sir:

In reply to within questions will say that I think the removal of my parents
and grandparents from Kentucky to Virginia may have been the cause of not
being enrolled (if they were not). I claim Annie Terry Estep, who was a niece
of John Ross, as my ancestor. I think John Ross was a party to the treaties
of 1835 and 1846. We pass as white and none of our ancestors were slaves that
we know of.

The physical signs on the Indian are distinctly noticeable in our people. My
father and mother were living in Kanawha Co. VA (now W Va) near where I
live. For further evidence in this, see affidavits of Loring D Hill and
others filed with the claim of Joseph R Hill (My nephew) of Lockwood, Nicholas
Co, W Va. I was born in 1832 and remember my grandmother, Annie Terry and
remember her resemblance to the Indians.

Yours Truly,
Lane S Branham
(we moved from KY about the years 1826-1838)
-----------

In the remark section of his claim, Lane Branham stated: "I have frequently
heard my mother and grandmother on my mothers side(whose maiden name was Annie
Terry) say that they were blood related to the Cherokee Indians as these
Indians frequently camped near them when passing through that country.

Other excerpts from other claims of relatives

Cornelius T Estep
Claim No. 44239
My grandmother Terry was said to be 1/2 Indian Cherokee.

Wilson McGraw
Claim No. 44207
Miles Terry, Annie Terry Estep's father's father was Miles Terry Sr., who was
called Devil Jet and belonged to Chief John Ross Tribe of Cherokee Indians.

Ruby McGraw Vencill
Claim no. 44159
"My great grandparents was Cornelius Estep and Annie (Terry) Estep's
father's father was Miles Terry Sr., who was called Devil Jet and belonged
to Chief John Ross Tribe of Cherokee Indians."

Also in 1907 a Jesse Terry who was at this time seventy-four years old stated
in an affidavit that Annie Terry Estep was a Cherokee Indian. This was the
same Annie Terry who was Miles and Hannah's Daughter. The paper also stated
that some Terrys had changed their last names prior to this to avoid being
connected to the Cherokee Indians.

Note:Records indicate there was a Miles Terry Jr., son of Miles and Hannah
Horton Terry, but he was a brother to Annie Terry. No research has yet
revealed if Annie Terry was in fact a niece to Chief John Ross.

Ross's father was Scottish and his mother part Cherokee.Ross's first wife was
Cherokee. If there was a kinship, likely Annie Terry may have been the niece of
Ross by marriage.

ALL EASTERN CHEROKEE CLAIMS FILED BY VARIOUS ESTEP, BRANHAM, HILL, MCGRAW AND
O'DELL ANCESTORS WERE REJECTED.In addition to "REJECTED," it was filed too
late. The enrolling agent wrote "It does not appear that any ancestor ever
enrolled but it does appear that applicants ancestors came from Kentucky to W
VA in about 1835. They were therefore not living anywhere near the Cherokee
domain and were not parties to the treaties of 1835-6 and 1846. Show no
connection with the Cherokee tribe.

Most of our ancestor's claim forms stated that "Devil Jet" belonged to
Principle Chief, John Ross of the Eastern Branch of the Cherokee.Ross was born
October 3, 1790 and died in 1866.From 1819 to 1826, Ross served as president
of the National Council of the Cherokee and assumed his position as Principle
Chief of the Eastern Cherokee in 1828. His Cherokee name was GU'WISGUWI'and
in boyhood was known as TSAN'USDI, "LITTLE JOHN".

Continuing research has revealed Hannah Horton Terry was most likely Cherokee.
The Eastern Cherokee Claims that were filed no doubt represent a tradition
that passed word of mouth for several generations. The claims, in part were
somewhat contradictory. In reviewing the copies of the claims, it appears
they were incorrectly filed through the descent of Miles "Devil Jet," as they
should have been filed through the descent of Hannah Horton Terry. After her
marriage, Hannah Horton, lived in the white mans world and was never enrolled
on any Indian census or lived on any designated Indian lands.

Herman Max Horton

Herman Max Horton, a long time resident of the city of Forrest City, died at
his home early Thursday morning February 12, 2009 at the age of 82, slipping
quietly away to be reunited with his beloved wife Alta, who preceded him in
death.

Many will remember Max for being an avid Razorback fan and for the many
stories he would tell while working his route as an insurance salesman for
Interstate Life and Reliable Insurance Companies. Max was a veteran of World
War II, serving in the U.S. Army as a medic.

Max was born on November 30, 1926 in Ethel Arkansas, the first son of fourteen
children born to Mack and Susie Horton who preceded him in death. He had three
siblings that also preceded him in death: Bennie and James Horton of Ethel and
Geraldine Maddox of Poplar Bluff, MO. He leaves those to mourn his return to
heaven the following:

Four children: Alice Sue Mason, Rebecca Kay Moore and April Marie Horton of
this city, Herman Max Horton, Jr. of Southhaven, MS.
Seven grandchildren: Angela Heard and Joseph Moore of this city, Michelle Like
of Colt, Heather Hazeslip and Heath Horton of Cabot, Patti Spain of Marion and
Guy Hamilton Moore of Nashville, TN.
Seven great grandchildren: Alisa Sue Elliott, James Nathaniel and Eli Like,
Elizabeth, Whitney and Jonathan Hazeslip, Elizabeth and Hunter Spain. Two
great great grandchildren: Darion Rock Reaves (Max's best friend) and his
brother Ja'rell.
Four brothers: Haynes Horton of Pine Bluff, Jimmie and Tommie Horton of Dewitt
and Floyd Horton of Ethel.
Six sisters: Nora Watson of DeWitt, Sue Noble of Morrilton, Linda Cummings of
Lonoke, Judy DePriest of Stuttgart, Nancy Posey of Bartlett, Tennessee and
Polly Emmons of Redfield. Max will be greatly missed by all of his family and
friends.

Funeral services will be held Saturday, February 14, 2009 at 1:00 p.m. at

US Government Pension
Isaac Horton Private $20 per mo Twice yearly March 1949-Sept 1854
(Thus death occurred between Sept 1854 and Mar 1855)

Age variations are to be expected in sources of this era, and we find a
variation of age in the 1850 census for what seems to be this Isaac Horton.
We know from family sources that Isaac and Mary Ann moved to Gwinnett County,
Georgia, and we find an entry in the 1850 census for them, strongly supported
by the report of birth in Pennsylvania for Isaac.

His age here is 96, which would be birth in the year 1754, earlier than the
age reported in the pension chart, and much earlier than the birth year of
1763 commonly reported, as in the Family Data Collection record above. The
birth date on his grave is also 1763. The latter is the birth date Isaac
himself reported in his Revolutionary War pension application.

On one side of them in House #936 is an Abram Horton, only 26 years old,
married also to a Mary An. This appears to be Isaac and Mary Ann's son.

Isaac N Horton 4 M R T b GA [b abt 1846]
Nancy L Horton 1 F b NC [b abt 1849]

This Abram (Abraham) is probably old Isaac's grandson, who moved later with
his brother Isaac to Blount County, Alabama.

"Abraham Horton, Sr. moved his family from Bucks County, Pennsylvania to Surry
County, North Carolina in 1767 where he died on 16 January 1816. Some branches
of the family moved to South Carolina about 1800. From South Carolina, Isaac
moved to Hall County, Georgia where he died. Two of Isaac's grandsons, Abraham
and Isaac migrated to Blount County, Alabama, and established the town of
Horton which is now in Marshall County. They built a mill complex on the
Little Warrior River."

On the other side of old Isaac is a Thomas Horton, age 51, and his wife Nicy.
Beth Walls Walton reports her as Nicy Nelson. The name Nicy (usually Nicey)
was a common nickname for Eunice.

Family sources confirm that this Thomas is Isaac and Nancy's son. His age in
the census entry above matches that in the genealogy report below. The young
Abram above would be Thomas' son.

Children of Isaac Horton and Mary Green are:
120 i. Daniel Horton, born 1796 in Pendleton, South Carolina; died 1860 in
Marshall, Alabama; married (1) Mary "Polly" East; married (2) Malinda Aft.
1854.
ii. Thomas G. Horton, born November 14, 1799; died 1859.
iii. Francis M. Horton, born 1800; died 1860.
iv. Jesse D. Horton, born November 16, 1802; died February 13, 1874.
v. Susanna Horton, born 1807; died Unknown.
vi. Lucy Horton, born 1810; died 1870.

Another of Thomas' sons lives a little farther down the road and is enumerated
a couple of pages later. This is Daniel, married to Mary (Polly) East, whose
parents are living a few doors down from them. There is also on the same page
a 28-year-old Jeffrey Horton, whom I have not identified, but suspect is
another grandson of old Isaac, and probably a son of Daniel and Mary. He is
born in South Carolina, as are both Daniel and Mary.

Georgia Gwinnett County: Inferior Court March term 1833

"On this 4th day of March 1833 Personally appeared in open Court - it being a
Court of record now sitting Isaac Horton a resident of the said County of
Gwinnett & State of Georgia aforesaid aged seventy years who being duly sworn
according to law doth on his oath make the following declaration in order to
avail himself of the benefits of the Act of Congress passed 7th of June 1832.

That he entered the service under the following named officers and served as
follows to wit - That he entered the service under the command of Captain
George Pierce - attached to the Regiment of Colonel Pacely [John Paisley] - &
the Division of General Davidson in Surry County in the State of North
Carolina as a private militia volunteer Soldier that he marched down below
Charlotte in North Carolina under the aforesaid officers from whence returned
through Charlotte pursued by the British to Salisbury - where the British Army
was for I while stationed.

That when the British left Salisbury this deponent with and at command of his
officers aforesaid pursued them to the Catawba River where they crossed at
nations Ford - that from thence they were marched to Sugar Creek as he thinks
in Rowan County - where they were stationed until he was discharged - that he
received a written discharge which has been since stolen from him - That said
term of service continued three months.

That a very short time after returning home he again volunteered under the
command of Captain John Morgan - Major McDowell - attached to General Morgan's
Division - and marched to South Carolina and was on duty at the battle of the
Cowpens. That after said battle he was employed to guard the prisoners to the
barracks in Virginia. After which he was again discharged which discharge in
writing was lost as aforesaid.

That soon after his returning home he was drafted and under Captain Morgan
aforesaid attached to Colonel Pacely's Regiment & General Davidson's division
- marched to some Ford on the Catawba [River] when the British attempted to
cross said River - that a Battle ensued in which General Davidson was killed.
He does not recollect the name of the place - when this tour expired he was
again discharged - and returned home - That he again volunteered soon after
his arrival at home under Captain James Gaines - Colonel Smith & General
Rutherford - and under their command marched to or near Wilmington - was in no
engagement during this term of service - which continued as ordered [?] three
months when he was again discharged regularly - in writing - that during the
said last term of service he acted as a Sergeant.

That soon after he again volunteered under Captain Gaines - Major Winston - &
Colonel Armstrong and marched to join General Green [Nathaniel Greene] at
Guilford Court House that the deponent was dispatched from the main Army with
some horses the day before the Battle of Guilford - as he returned he met with
Captain Kell [James Kell?] who was marching to attack Fannin [David Fanning] a
Tory Captain at Lindley's Mills - in or near the line of Guilford County -
that he together with his Associates were persuaded to join Captain Kell and
were with him in a battle fought with said Fanning - that they defeated
Fanning - after which he again joined General Greene - and was with him at the
battle of Eutaw Springs [September 8, 1781]-

Soon after which he was again discharged in writing - which discharge he lost
as well as all others that he received - as above stated to wit - they were
stolen from him. That at the Close of the war old when he was last discharged
he settled in Surry County aforesaid where he lived 2 years - from thence he
moved to Spartanburg in South Carolina where he also remained 2 years - thence
to Pendleton in the State last aforesaid - married and remained there 30 years
or upwards - from thence he removed into HALL COUNTY in the State of GEORGIA &
lived there 7 years - from there he removed to his present residence in the
State of Georgia & County of Gwinnett aforesaid.

The affidavits of David Southerlin appended will establish the truth of what
he states in relation to 2 of his above tours or terms of service - the other
terms he has no evidence to establish except his own oath. He hereby
relinquishes every claim to any pension or annuity except the present - and
declares that his name is not on the pension roll of the agency of any State.

Sworn & subscribed in open Court the day & year aforesaid.
S/ Isaac Horton, X his mark"

[Silas King, a clergyman, and Jalen Ivey gave the standard supporting
affidavit.]

Georgia Gwinnett County:

"Personally appeared before me the undersigned a Justice of the Peace in & for
said State and County Isaac Horton who being duly sworn deposeth and saith
that by reason of old age and the consequent loss of memory he cannot swear
positively as to the precise length of his service - or as to the precise
periods of the war in which he served but according to the best of his
recollection he served not less than the periods mentioned below and in the
following grades - and as near as he recollects at & during the following
periods of the war. For 3 months I served as a private volunteer militia
soldier in the year 1780.

That for 3 months I served as a militia volunteer private soldier in the year
1781. For 3 months I served as a private drafted militia man in the year 1781.
For 3 months I served as a Sergeant of militia in 1781 or 82. For 3 months I
served as a private militia volunteer soldier in the year 1782 and for such
service I claim a pension. And further amendment to his declaration and in
answer to the objections made by the War Department to said declaration the
deponent answers and says That he was born in the State of Pennsylvania in the
County of (he believes) Bucks in the year 1763."

-------------------

This pension application information was included on the Find a Grave memorial
for one Mary Horton Tharp, who Walton reports as a daughter of Isaac and Mary
Ann. This Mary Horton does not appear in other lists and sources as a
daughter of Isaac and Mary Ann.

Walton presents some compelling circumstantial evidence, including a son named
Isaac, to conclude that Mary Tharp is Isaac's daughter. I note, however, that
Mary Ann's birth year is reported as 1786, which is considerably before the
next known child's birth, Daniel Horton, born in 1796.

Even so, the reported approximate date of Isaac and Mary's marriage was 1782,
accommodating the birth of Mary Horton in 1786. But were there no interim
children between 1786 and 1796?

His military grave marker reads as follows:
Isaac Horton Continental Line Revolutionary War 1763 (corrected from other
sources to 1754) 1854
-- Gravestone of Isaac Horton, Sugar Hill First Baptist Church Cemetery
Register, http://www.oldplaces.org/gwinnettga/cemeteries/sugar_hill_3.html

The date of birth is 1754, going by his reported age of 96 in the 1850 census.
A family source has also annotated the photo of his grave marker with a
corrected date of birth of 1754. Note also that the register of the cemetery
has recorded his date of death as 1853, even though the marker says 1854. The
latter is the correct year, as reported by his Military pension records, which
stopped after September 1854.

"A Gwinnett County delegation Friday held a memorial service for Revolutionary
War veteran Isaac Horton, who died in the Sugar Hill area of Gwinnett County
in 1854. The ceremony took place at the Sugar Hill Baptist Church where a
government marker was placed to honor Horton, whose real burial site is
unknown."

A Social Security record clarifies that one child was named James Kenneth.
The birth date of 19 May 1929 here correlates with the 1930 and 1940 census
reports for the child named Kenneth. But note that the 1840 census also
reports another son, 5 years old, named Jimmie. Jimmie is the common nickname
for James. Did they name one son James Kenneth and the other son Jimmie as
the given nmae? Seems odd.

Horton posted on Facebook by one of their grandchildren. James appears with
the bickname Boodler. Als in this list is a Jimmy, which normally stands for
James. They must have had one child named James and another named simply the
nickname Jimmy as the given name.
