In the 1870 census she is called Julia. This name Judith got entered in numerous ways for every individual with that name. In the June 1880 census for Reuben, his wife J M is enumerated with him. But there is a record of death that also appears to be for Reuben's wife Judith Margaret. The age of J M in this death record, 27, matches the age in the family enumeration. The death record reports that J M McSwain died in November 1879. Her death is recorded in the mortality tables of the 1880 census for North Carolina, but I have not seen an actual death certificate. This matches the reported birth of Elijah McSwain here in November 1979. The 1880 census child Elijah matches the child Elijah reported by the Hamrick data. So it seems that Judith died in childbirth with Elijah, even though she is stil recorded as Reubin's wife. 1880 Federal Census Mortality Schedules, Cleveland County, North Carolina, August 7, Sandy Rim, Enumeration District 71, Line 4 J M Mcswain White Female, Married Age 27 born (abt 1853) North Carolina Normal Occupation Keeping House Death Nov 1879 Sandy Run, Cleveland, NC Cause of Death Uterus Hemorrhage However, the Hamrick Data Pages report that an unnamed child of the family was born about 1880. Despite their report that a child was born about 1880, the Hamrick data also reports that Judith Margaret McSwain did die in 1879! The Hamrick data includes no discussion or explanation. In the 1900 census I found Judith's son Elijah living in the household of Judith's brother Berryman (called Berry in this census). He is in a household of several nieces and nephews of Berry, whom I cannot identify. Note that as occurs over half the time in the 1900 census, Elijah's year of birth is wrong, saying 1879 when we know his mother died in November 1879. 1900 Federal Census, Cleveland County, North Carolina, 15 June, Township 7, District 57, page 11A, Hse #176, Fam #181 McSwain, Berry Head W M Sept 1841 58 Single NC NC NC Farmer Owns Lovelace, Mary sister W F May 1830 70 Widow 2 children/1 living NC NC NC McSwain, William E Nephew W M Octo 1870 29 NC NC NC Teaching School McSwain, Lula Niece W F Feb 1874 26 Single SC SC SC McSwain, Pantha N Niece W F Jan 1877 23 Single NC NC NC McSwain, Elijah Nephew W M Nov 1880 20 NC NC NC At School

Jerry Gallagher's information on the Padgetts was one source for evaluating the link of the McSwains and Padgetts in Arkansas. He follows the Sarrett date of 1840 for her birth, which the Hamricks suggest as abt 1841. 1860 Federal Census, Cleveland County, North Carolina, 14 August, page 72, Hse/Fam #511 Lewis McSwain 46 M Farmer $500 real estate $3280 Personal NC Mary McSwain 44 F NC Judy N McSwain 26 F NC See later enumerations for Judith in Notes for W Edwin Padgett. Judith listed in the 1870 census as Juliah, age 36. This matches the age reported in the 1880 census, age 46 to yield a birth year of 1834. These ages indicate a birth year of 1834, so it seems best to follow this, though sources of allied families use a later date in their genealogies. I have followed specific birth information on Judy which I found in the LDS FamilySearch online information: JUDITH N. MCSWAIN Birth:14 JUL 1834, Rutherford, North Carolina Death: 28 AUG 1897 In 1870 the family, along with Edwin's parents and family, are in Cocke County, Tennessee. We know their first daughter was born in Arkansas in 1871. It is not clear exactly when they left North Carolina and arrived in Tennessee. Their second son John P, age 3, is reported as born in North Carolina. So they were in Tennessee no earlier than 1867. In 1870, Edwin has moved west and is enumerated in Cocke County, Tennessee, in the mountains of East Tennessee, near the North Carolina border. 1870 Federal Census, Cocke County, Tennessee, 23 August, District 9, page 18, Hse #123, Fam #124 Padget, Edwin 32 M W Farmer NC (b abt 1838) Padget, Juliah 36 F W Keeping House b North Carolina (b abt 1834) Padget, William C [E?] 5 F W b North Carolina (b abt 1865) Padget, John P 3 F W b North Carolina (b abt 1867) Incidentally, they are living in Cocke County, with a Newport (county seat) post office address. This is the town where most of the children of Orville's great-grandfather Dock Patrick Gregory were born. Dock and Julia Ann Clementine (Strange) Gregory lived just across the county line in Jefferson County, and perhaps in Cocke County part of the time, before they moved to Oklahoma about 1895. Edwin and Judith are enumerated in Arkansas County in 1880, along with a number of other Padgetts and McSwain of their family. Edwin's parents are there, and Edwin's sister Martha Elizabeth is married to a distant cousin of Judith named Phillip K McSwain. Edwin's mother is a McSwain, a relative of P K's father George McSwain. 1880 Federal Census, Arkansas County, Arkansas, 19 June, Prairie Township (Ethel), District 2, page 24A, Hse #171, Fam #182 Edwin Padgett Self M Male W 41 Farmer NC SC NC Judy Padgett Wife M Female W 46 Housekeeping NC NC NC W E Padgett Son S Male W 15 NC NC NC John Padgett Son S Male W 13 Works On Farm NC NC NC Mary Padgett Dau S Female W 9 AR NC NC Edna E Padgett Dau S Female W 7 AR NC NC Minneola Padgett Dau S Female W 5 AR NC NC We learn from the Holden Genealogy by David Holden that the full name of the son W E is William Ensley. McSwain, William (*1826 - ) father: McSwain, Thomas (1796 - 1872) mother: Bridges, Salena W "Frankie" (1793 - 1862) spouse: Gipson, Malissa (*1830 - ) spouse: Ledbetter, Arrienia (*1829 - ) ----------child: McSwain, Thomas (*1846 - ) ----------child: McSwain, William Anonymus (*1853 - ) ----------child: McSwain, Salena (*1860 - ) ----------child: McSwain, Vianna (*1860 - ) ----------child: McSwain, Henry (*1861 - ) ----------child: McSwain, Frankie (*1861 - ) ----------child: McSwain, Isabell (*1861 - ) ----------child: McSwain, Josina (*1861 - ) The child called Vianna by Hamrick matches the child reported in the census as Vina C. This name is probably short for Levina, or Lavinia. Many women with variations of this name were called Vina, Viney or other variations of this nickname. But note also a new entry of Selena. There is no name similar to this in the 1860 census. But note that Vina's middle initial in 1860 is C. This could be for Celina, matching phonetically the name spelled Selena in the Hamrick data. Vina (Vianna) and Selena seem to be the same child. Another decendant reported the last child as Josina, matching the Hamrick list. "My father's grandmother was Josina A McSwain Bridges the youngest child of William D and Arrenia Mcswain. My dad has told me stories of talking to William Henry McSwain (Uncle Henry) and aunt Frank (Frances or Frankie McSwain) when he was a boy. He is now 87 and I have some 1st hand accounts and other info I have found." -- David Bridges, email to Orville Boyd Jenkins, 2 March 2017
Researcher David Holden comments on Lavinia McSwain, "From the North Carolina side, Lavinia is usually referred to as Nancy" -- David Holden, email to Orville Boyd Jenkins, October 2007. But his comment is the only reference I have found to Lavinia McSwain Padgett having the name Nancy. In a new focus on this family, reviewing records that have come to light in the meantime, in July 2017 it is now clear that a burial is found matching Nancy McSwain Padgett in McSwain Cemetery near Shelby, North Carolina. The stone for this grave reports the death of 17-year-old Nancy Padget, "consort of Wilie padgett [sic]." This young wife died at age 17 in 1938. This fits other details and records to indicate that this would be a first wife of this same Wiley Padgett. Thus Wiley had a wife named Nancy and a wife named Lavinia, daughters of different couples in the McSwain clan of Cleveland County, North Carolina. Holden's comment may reflect a conflation of identity of these two different wives. No information has been found of any children of Wiley and Nancy. The birth of Lavinia McSwain Padgett's first child is close to a match for a marriage in about 1838, the year Nancy Padgett died. Census ages vary, and in the 1850 census, John was reported as age 15, which would be before the death of Nancy Padgett in 1838. Nancy was only about age 13 in that year, so it is not likely she was John's mother. So later indications may be closer, yielding birth in 1838 or 1839. In the 1850 census, Lavinia and her husband Wylie Padgett are enumerated in their families' long-time home area of Cleveland County, North Carolina. 1850 Federal Census, Cleveland County, North Carolina, 4 September, p 316, Hse/Fam #597 Wyly Padgett 45 M Farmer NC Lavinia Padgett 31 F NC John H Padgett 15 M NC Edwin Padgett 12 M NC Mary K Padgett 7 F NC Barbara E Padgett 6 F NC William Padgett 4 M NC Elizabeth Padgett 3 F NC Nancy J Padgett 2 F NC Caroline Padgett 1month F NC If John is Lavinia's son, it means she got married when she was about 15 or 16 years old. Martha E Padgett married Catherine's son Phillip K McSwain about 5 years after the census, when both families had moved or were moving to Arkansas, where they were all enumerated in 1880 in Prairie Township of Arkansas County. Nancy J is the Jane of later censuses, who apparently never married. In the 1900 census, we find her living with Phillip and Martha, and she is later with Maggie, Philip's oldest daughter and her family. Her sister Harriet married Phillip's brother George. Wiley and Lavinia's daughter Levina Padgett married George and Phillip's brother Julius McSwain. In 1880, the family are in the Ethel area of Prairie Township of Arkansas County. It looks like the Padgetts and McSwains arrived there about 1875 or 1876. See notes on other McSwain and Padgett individuals for various details. Descendants of this extended family, under several different surnames, are still found in the various areas around there today. 1880 Federal Census, Arkansas County, Arkansas, Prairie Township, page 16, Hse #106, Fam #109 Wiley Padgett W M 72 Self Farmer SC SC SC Lovinia [Lavinia] Padgett W F 62 Wife Housekeeping NC NC NC Jane Padgett W F 26 Dau Single NC SC NC Jas. The 1900 Census reports her name as Lee O. Lee was possibly a nickname for Leona, or the enumerator took Leeona as two names. In 1910 she is reported as Leona E. A marriage record that appears to be for her has her name as Leann in the Ancestry transcription. This could very well be a misreading, as is so common with the Ancestry transcriptions. Her name was spelled by the clerk/notary who wrote out her father's will in the court records as Lenona. 1900 Federal Census, Arkansas County, Arkansas, 19 June, Prairie Township, District 7, Page 13B, Hse #218, Fam #293 McSwain, Phillip K Head W M Jan 1847 53 Married 25 years NC NC NC Farmer McSwain, Marth [sic] E Wife W F Oct 1847 52 Married 25 years Housekeeping NC NC NC McSwain, Joseph Son W M Nov 1879 20 AR NC NC Farm Laborer McSwain, Robert F Son W M Sept 1882 17 AR NC NC Farm Laborer McSwain, Benjamin Son W M June 1886 13 AR NC NC Farm Laborer McSwain, Lillie Dau W F Feb 1888 12 Single AR NC NC McSwain, Lee O Dau W F Mar 1891 9 Single AR NC NC Padgett, Lavina Mother [actually mother-in-law and kin to him a couple of other ways] W F Mar 1819 81 Widowed NC NC NC Padgett, Jane Sister [actually sis-in-law & 2nd cousin] W F Jan 1849 51 Single NC NC NC McSwain, Lester Grandson W M Mar 1899 1 AR NC NC Criswell, Harvey Boarder W M Jan 1876 24 Single MS VA AL Jenkins, Andrew Servant W M Apr 1878 22 Single TN GA GA 1910 Federal Census, Arkansas County, Arkansas, 22 April, Prairie Township, District 13, page 4A, Hse/Fam #58 McSwain, Philip Head M W 69 Married 36 years NC NC NC Farmer McSwain, Martha Wife F W 67 Married 36 years NC SC NC McSwain, Lillie M Dau F W 22 Single AR NC NC McSwain, Ben Son M W 4 Single AR NC NC Dry Goods Salesman McSwain, Leona E Dau F W 18 Single AR NC NC McSwain, Lester Grandson M W 11 Single AR NC NC 1920 Federal Census, Arkansas County, Arkansas, 3 February, South Prairie Township, District 16, page 6B, Ethel-St Charles Rd, Hse #113, Family #117 Price, Ralph C Head Owns M W 30 AR TN AR Farmer (b abt 1889) Price, Leona E Wife F W 28 AR NC NC (b abt 1891) Price, Katherine L Dau F W 2yrs8mos AR AR AR (b abt Apr 1917) Price, Charles M Brother M W 36 AR TN AR Mechanic (b abt 1883) Arkansas, County Marriages Index, 1837-1957 Leann E McSwain Age 23, Birth Year 1891 Residence Ethel, Arkansas, Arkansas Spouse's Name R C Price Spouse's Age 25 Spouse's Residence Ethel, Arkansas, Arkansas Marriage 1 Jul 1914 Arkansas County Marriage License Date 30 Jun 1914 1930 Federal Census, Arkansas County, Arkansas, 19 April, Brinkley, District 2, page 4B, Main St, Hse #81, Fam #96 Price, Ralph C Head Rents $20 M W 41 First married at age 25 AR NC AR Salesman, Washing Machine Factory Price, Leona E Wife F W 39 First married at age 23 AR NC NC Price, Katherine E Dau F W 13 Single AR AR AR 1940 Federal Census, Johnson County, Arkansas, 2 April, Clarksville, District 36-23, page 1A, 209 Cherry St, Hse/Fam #1, Rents, $20 Gregory, Ralph Head M W 51 Married Grade H4 b Arkansas Hot Springs, Garland Co AR in 1935 [b abt 1889] Gregory, Leona Wife F W 49 M Married Grade H4 b Arkansas Hot Springs, Garland Co AR in 1935 [b abt 1891] U.S., Social Security Death Index, 1935-2014 Leona Price Born 1 Mar 1891 Died Apr 1979 Last Benefit Address Daphne, Baldwin, Alabama 36526 SSN 432-30-7743 issued Arkansas (Before 1951)
