The birth of Duncan Terry would be at the age of 50 for Constance, reported
wife of Lewis Terry.  It is possible that there was a second wife that is not
reported in this Terry genealogy.

Notes for Duncan Lafayette TERRY


The Terry Family History reconstructed much of Duncan Lafayette Terry's life. 
This was the starting point of my investigation into his life, as a cousin of
my great-grandfather Thomas Duncan Terry.  That research reports limited
details of the last few years of his life.

He was known by the nickname Fait/Fate.

The will of Duncan Terry refers to Duncan L Terry as the youngest child of
Duncan Terry.  He is willed a slave family, named as "Dennis my Negro man 42
years old, Edna his wife 29 years old, Harriet a girl a year old, Sally 4
years old and John one year old and the home place known as part of a lot of
land No. two hundred and ninety-nine and a portion of lot to this hundred
which fill ... to my part of my father's estate in  this divide of his land." 
These are willed to his wife till Duncan is 21 years old.  Duncan, born in
1855, would have been 7 years old when his father died.  I do not have the
exact month of Duncan Lafayette's birth.

In 1870 Duncan Lafayette is in the home of his widowed mother Wysetty Terry.

They sold the land and moved west before his mother's death.  They moved to
Scott County, Arkansas, near Waldron, east of Little Rock.  Wysetta lived to
be 104 years old, surviving an Indian attack on their Arkansas homestead, and
suffering a scalping that left her injured and living with a metal plate in
her head for the rest of her life.

Duncan Lafayette later moved west near Fort Smith, then finally into eastern
Indian Territory, while cousins were in northern Texas and southern Indian
Territory.  In 1880, he was enumerated in the U S Census with his wife Harriet
Sliger.  Note that her nephew's family name is spelled Sligo by the
enumerator.

"He had his saddle riders full about two gallons It was two or three months
ago:  he saw it:  I bought a quart from him paid him $2.00.  Have seen him
sell plenty of it:  have seen him off & on return three years with as much as
five gallons:  his business then was selling whiskey."

On 29 July 1889 Duncan Lafayette Terry was tried and convicted, and sentenced
to serve 2 years in the Ohio State Penitentiary.

Great Grandpa Was a Convict

If you get involved in genealogy or the study of your family history, you can
learn a lot of interesting things. I think I'm interested because I want to
know where I come from, why I am like I am. I don't have time to do a lot of
research now, but a few years ago I did a bit, and put up a family history
Website. Through that site I came in contact with a number of relatives who
now supply me with research.

My cousin Ann, who is devoting her winter to researching the Terry line has
come up with some interesting info. First she found the court records showing
that in July of 1889 my Great Grandpa, Duncan Lafayette Terry, or "Fate" for
short, was convicted on 4 counts of "Introducing and Selling Liquor in the
Indian Country," and was sentenced to serve 2 years in the Ohio Penintentiary.
Bummer.

Penitentiary records describe him physically as a man of 5'10 3/4" height,
greenish blue eyes, light brown hair and fair skin. They also cataloged his
scars and marks, and gave a more detailed description, but I'll save that for
the Website. Another page describes his habits as "intemperate." So he was a
drinker. ...

Next up, Uncle Louis "Luke" Terry: Arkansas Deputy Sheriff convicted of
manslaughter and tried for murder (after he got out of jail for the first
crime). I have the transcript for the preliminary hearing of the latter trial.

"Duncan Lafayette Terry: I'm noticing on several family trees regarding Duncan
Terry and Harriet Sliger that they are missing my grandmother.  My grandmother
is Hettie Maye Terry Mosley Trotter [daughter of Duncan Lafayette Terry and
Harriet Sliger].  Her siblings were Ola, Donnie, Louis Alexander and William
Lafayette.  She was born Dec 12, 1886 in Indian Territory, Oklahoma and died
April 15, 1969 in Los Angeles, Calif.  She had 3 children, Olive Mosley,
Maggie Mosley and Woodrow L Mosley (my father).

Ina died in 1905.  Soon after Ina's death that same year D L married Mollie

The 1910 census reported Lafayette and his third wife Mollie Gaddy, with a
grandson Rosco Grant (or some similar name, hard to read in the census).  They
were in Prices Chapel, Sequoyah County, Oklahoma.  This is consistent with our
earlier information of him in Choctaw Nation, out of which was created LeFlore
County, Oklahoma, bordering Arkansas, where he had lived earlier after
migrating west after 1870 with his mother.

Mollie had several children with her first husband Stephen Gaddy.  She and
Duncan had no children.

" I found a letter that Terry wrote to one of his daughters and it was written
on Christmas Eve in [1910]. He says that Steve, Roscoe and Ethel [and Elmer]
are coming for Christmas. Duncan and Mollie are living with a grandchild in
1910 and it is hard to read the name. It looks like Roscoe Gunt....probably is
Grant. Roscoe served 7 years in a Huntville prison for being in on a robbery
that ended in a killing of a constable. He didn't fire the gun. They were off
their military base at the time."

Place of death of Duncan Lewis Terry is uncertain.  In 1880 the family is
found in Fannin County, in 1900 widow Tabitha is found with son Joseph William
in Burnet County.

There is a family tradition right out of the wild west about the death of
Duncan Lewis, that some of us are trying to find documentation about.  The
information is related by Jacque Watkins, a granddaughter of Duncan:
"I am looking for a story (newspaper, etc.) about Duncan Lewis Terry having
been killed by stabbing in a quarrel over a horse deal. That is the family
lore that I have to date as to his death. I don't know where it happened.
Supposedly in Oklahoma or Texas or New Mexico. Maybe at Milano, Milam County
[Texas], where Thomas Lewis' store was (I have heard that it may have happened
at the store). He was a cattle driver supposedly and this is how he supported
his family."

Indian Territory/Oklahoma, not to mention some of my Jackson and Green

Ella Vastalee Terry was born in Sweetwater Oklahoma on August 19, 1925 to Owen
Terry and Maggie Mae Terry and passed away May 6, 2016 in Broken Arrow
Oklahoma at the age of 91 years, 8 months and 26 days.

She grew up at their farm in Sweetwater and graduated High School from there.
After graduation, she moved to Clinton Oklahoma where she worked until she got
a job with the Telephone office(AT&T), where she met Sgt. Conner Hicks, and
married him in Clinton. After the war, they moved to Pampa Texas where Mrs.
Hicks transferred in her phone operator job, and her husband found work,
eventually going to work for the United States Postal service! They lived in
Pampa where their children Donald B. Hicks and Cynthia E. Hicks were born and
raised. After Cynthia was born she worked as a book keeper for the Pamcel
Federal Credit union. She outlived her husband and continued in Pampa, until
circumstances with her health 2011, caused her to move to Tulsa Oklahoma where
she lived until her passing.

She was preceded in death by her parents, husband, grandson, Donnen Hicks, 3
brothers and 3 sisters.

She is survived by her daughter Cindy Smith of Broken Arrow, OK; son, Donald
B. Hicks and wife, Cathy Marana, AZ: 3 grandchildren Andrew Smith and wife,
Valorie, Kellyville, OK; Sarah Griffen and husband, John, Bixby, OK; Jessica
Goree and husband, Lee, Glendale, AZ; 6 great grandchildren; 2 brothers, W.O.
Terry and wife, Thelma of Canyon, TX and Leo Terry and wife, Mary, Orange,
TX., and a host of other relatives and friends.

"Former Resident of Clyde Succombs at Tahoka - E. B. Terry died at Tahoka,
Texas, Friday, August 28th, at 2:20 a.m. and was buried at 2:30 Saturday at
that place. Mr. Terry formerly lived at Clyde and had many friends here. He
had been in ill health for several months with that dreaded disease, cancer.
Mmes. L. F. Coffman and L. F. Patterson, sisters of Mr. Terry were at his

What little information can be gathered suggests Ester was born in a village
on the border of Virginia and North Carolina, near Bladen Co NC (now in
Robeson Co). However, SAR records for her husband John state she was born in
Highland Co OH. It is my belief she was not born there, but may have been
listed as such due to her Quaker affiliations.

Ester was one of possibly five children born to fur trader William Terry (aka
Terriy) and his Cheraw Indian wife, Cheepoake Harris.

It is confirmed Ester married John C Burris Sr, a Quaker, in 1758 in Rowan Co
NC (then part of Surry Co, now Stokes Co) NC. They had at least nine children,
seven sons and two daughters. The children's births are recorded in the Quaker
Meeting Minutes of New Garden in Guilford Co NC. Additional records regarding
this family can be found in the Fall Creek Meeting Minutes in Rainsboro,
Highland Co OH.

As Ester's birth was before Indian Rolls were established by the Guion Miller
Commission 1908-1910, any future claims by descendants to prove Indian
heritage is disallowed. One source references such a claim. The rejected
application for tribal membership was submitted by Emma C Williams, a
Gr-Gr-Granddaughter of Daniel Burris (1771-1845), son of John and Ester.

The Cheraw tribe is recorded to have originated in FL and sometime prior to
1700 moved to an area near the Dan River, on the present day Virginia-North
Carolina border. In 1738, just two years before Ester's birth, a smallpox
epidemic killed most of the Cheraw and Catawba tribes. Survivors of these two
tribes combined, with a few relocating north in a new settlement along the
Drowning Creek River, now located in Robeson Co NC. By the middle of the 18th
century, this tribe was mostly gone.

It is unlikely Ester's mother and father were in the area at the time of the
smallpox epidemic. As a fur-trader, her father would have moved them
frequently. No death record has been found of Ester's parents, as yet. The
research is ongoing. Her father may have died in 1792 near Botetourt Co VA.

part of Bladen Co NC.

There was a seocnd 1910 enumeration of this family.  They were both on the
same day, and include al lthe same peoel.  I dno't know hwo this would have
happened.  tehse counties are a long way apart.  I suspect Ida was in one
probably with younger children, and some of the chidlren, probably the older
ones, were in the other, and all were reported to both enumerators.  In the
Yavapai County enumeration, the oldest son's name looks like Ewert or maybe
Ernest as Ancestry interpreted it.  (The number of loops are the same for both
those names.)

In the WWI draft registration, the name entry and his signature look like
Ewart, more than Evert or Evart as it has appeared to me in the censuses
except Yavapai 1910.  The genealogies I have seen all follow Ancestry in
reporting this name as Ewert (or Ewart).  Perhaps this was his name.

The Wells Gazette above reports that Ewart died about July 1930.  In the 1940
census, we find his wife Doris remarreid to a widower named Kent.  Her two
children Forest and Barbara are in the household.  Her son Forest Allen is

From the 1900 census record, Flora's parents James and Phoebe moved from
Tennessee to Texas between September 1890 and December 1892.  Flora's death
certificate reports that she was born 1893 in Breckenridge, which is in
Stephens County, 3 counties west of Ft Worth.  By 1900 they were living in
Wise County, just west of Ft Worth.

From the 1900 census record, we can tell that ames and Phoebe moved to Texas
between September 1890 and December 1892.  Their daughter Flora's death
certificate reports that she was born 1893 in Breckenridge, which is in
Stephens County, 3 counties west of Ft Worth.  By 1900 they were living in
Wise County, just west of Ft Worth.

Allen's birth date here is reported as 11 June 1888.  That would mean that
where the 1900 census reports Allen was only 7 years old, according to the
family source, he would have been actually 12.  That seems like a big error to
make in the census record.  Who made the error?  Did the parents mistake a

For some reason several genealogies have reported his death date as 18 June
1953.  But the death certificate and gravestone clearly have 1955.

Forrest's father died abotu July 1930, according to the Wells genealogy.  His
mother married a widower name William Kent. In the 1940 census, we find
Forrest's mother Doris with her two children Forest and Barbara in Bisbee,
where Forrest was born.  It appears they married before 1935, as they all are
reproted as being in the same place in 1935.  Here Forest's middle name is
reported as Ernest.
