Before finding this 1940 census, I had not been able to find a marriage record, though Texas records are online. The birth record of the daughter might be available, now that I have her name. The designation of Josephine Arriaga as the daughter-in-law of Carl indicates this is Mary's daughter from a previous marriage. Since Josephine is married, her surname, and her mother's married name, is not known. But Manuel Benitez is designated as Carl's stepson. THus Mary's married name was Benitez. The relationshp designation for Josephine is somewhat confusing, having initially "Daughter-in" but then the "in" was marked through. On the line for Anthony Arriage, the designaiton first written was Step-daughter, then that was marked out, apparently because it was on the wrong line, and likely intended for Josephine. Anthony is then designated as Son-in-law. The name is spelled Winter in censuses and most records, but on occasion it is Winters. It is found as Winters in several genealogies. It seems that Winter is the primary form. The husband of Nell Jenkins, daughter of Joseph Sanford Jenkins, was known in the Jenkins family as Jim Winters, but no details were known. Wiley's son Nelson married Nell's younger sister, Sarah Catherine. This connection and the family's location in Cass County led me to James G, brother of Wiley. The family name is recorded variously as Winter or Winters. I believe the original family name was Winter, but some family sources as well as censuses use the plural spelling. James G Winters Birth 1835 in Madison, Alabama Death 1871 in Titus, Texas Parents Daniel Winters b 1790 in Texas, d 1841 in Titus, Texas Lavinia McDaniel b 1802 in Alabama, d 1870 in Cass, Texas no spouse reported -- Matthews Family, http://trees.ancestry.com/tree/5515797/person/-1438496322 In the 1850 census, an individual who appears to be this James (Jim) Winter(s) is in a mixed household of two families. There are two households and three families related in the first entries of this Precinct. James is enumerated as a member of the household and family of William Thomson. William is next door to of Benjamin Winter, who was also born in Alabama. Benjamin's wife appears to be a member of the Thomson family, but the configuration is not clear. Mary J Winter was born in Pennsylvania, as was John B Thomson and two younger Thomsons in their household as Family #2. The next door household and family are also Thomsons, with the two Wnter children in that household. 1850 Federal Census, Cass County, Texas, 5 November, Precinct 4, page 761, Hse/Fam #1 ** Benjamin S Winter 25 M Farmer $450 Real Estate Value b Alabama Married within the year [born abt 1825] ** ** Mary J Winter 17 F Born Penn Married within the year [born abt 1833] ** - Hse #1, Fam #2 - John B Thomson 23 M Merchant No Real Est rptd b Penn [born abt 1827] J E Thomson 12 F b Penn [born abt 1843] S A Thomson 9 F b Penn [born abt 1845] - Hse #2, Fam #3 - William Thomson 50 M Farmer $640 Real Estate b South Carolina [born abt 1800] Davis Thomson 46 F b Alabama [born abt 1838] Joseph C Thomson 3 M b Tex [born abt 1847] ** James G Winter 15 M Laborer b Ala [born abt 1835] ** ** Caroline [Winter] 9 F b Tex [born abt 1841] ** Parker Culberth 19 M Laborer b Ala [born abt 1831] M H Riley 52 M b Ohio [born abt 1798] Caroline has no surname, and no ditto mark to indicate the name was Winter. Ancestry interprets her surname as Winter. I had no information form other sources about a Caroline Winter(s). In August 2019, a descendant of Caroline contacted me about this family, reporting that she was descended form Caroline, the daughter of Lavina Winters. James and Caroline' mother was Lavinia Elliot McDaniel. In 1860, James is in the same area, but now in the household of William Millsop. 1860 Federal Census, Cass County, Texas, 17 October, Beat #3, PO Unionville & Cusseta, page 70, Hse #467, Fam #479 Wm Millsop 60 M Farmer $3500 Real Estate $600 Personal Estate born SC L Millsop 58 F born Tenn J Millsop 13 F born Tex Jas J Winter 25 M $300 Personal Estate born Ala [b abt 1835] I later found, through Ancestry.com, James' Confederate army registration card. This indicates they were still in Cass County in 1862, and he enrolled in the Confederate army as a Private. This registration does not indicate whether James was married. I have found no record of his marriage to Nell Jenkins. Several genealogies cnosider this the same james G Winter/s who was the son on Daniel c Winter/s and Lavinia McDaniel. There is no marriage information, and these genealogies do not report Nell Jenkins as a first wife. The Jenkins family informaiion knows of onlty Nell Jenkins as the wife but has no information on marriage date or Nell's death. No further infromation has been found on Nell Jenkins. similarly, no further informatoin has been found on a brother of James G (Jim) Winter/s named Troy. 1870 Federal Census, Titus County, Texas, 8 July, PO Mount Pleasant, page 5, Hse/Fam #31 Winter, James G 35 M W Farmer $500 Real Estate $500 Personal born Alabama [b abt 1835] Winter, Mary 34 F W Keeping House b Alabama Father and Mother of foreign birth [b abt 1836] Winter, James W 10 M W At Home born Texas Cannot Read or Write Winter, Mary E 8 F W born Texas Attended School this year Winter, Melvey 1 F W born Texas This could be the same person as the Jim Winter(s) who married Nell Jenkins. But the wife reported here is named Mary. Some genealogies report her name as Mary Elizabeth Griffin. The Morris-VanNoy genealogy reports James as James G Winters and has the same birth place, Madison County, Alabama. This tree reports the wife as Mary Elizabeth Richter, but has no documentation or comment on the marriage fact. But another Ancestry genealogy shown as a source for the Morris-VanNoy tree does have parents of James G WInters who married Elizabeth Richter as our Daniel and Lavinia McDaniel Winters. James G Winter Mary Elizabeth Richter (1836-1930) 20 Oct 1860 Henderson, Texas, USA -- Morris-VanNoy Genealogy, Ancestry, https://www.ancestry.com/family-tree/person/tree/49799421/person/392108403904/facts?_phsrc=UDo2077&_phstart=successSource Like the trees that report the wife as Mary Elizabeth Griffin, the Morris-Van Noy tree has only this one wife, so there may be two similar Jim WInters. Morris-VanNoy has no parents for James G Winters. In rt he 1870 census, Mary is 10 years older than Nell, who is reported by Jenkins family sources as born in 1846. If this is the same James G Winter(s), then Nell must have died before 1870. They could not have been married very long. We have no details or death date for Nell, so at this point we cannot say if she died early, of if her husband Jim was married again. I am including this census entry here for reference, with these clues as reference points for confirming if this is the same James/Jim Winter.

The b irth dte of their oldest child Mary Ann, reported in the Winter-Conley family Bible, is 1 August 1874. This suggests that James and Nancy Elizabeth married in 1873. In the next two listed households are her brother William Thomas Winter and her father and stepmother, Stephen and Helen WInter. Birth dates of parents in this 1880 census are uncertain, because the entries are inconsistent. For the children, most have only the individual's birth state, and no separate entry in the field for Mother or Father's state of birth. So it seems we are to assume the states reported in their parents' individual records. But on others it seems the enumerator followed the common practice of drawing down the last entered state in that same column. like a ditto. And on a couple of the parents, not all fields are fulfilled, which we usually take to mean the information was not known. 1880 Federal Census, Grayson County, Texas, 1 July, Whitesboro, District 7, page 44, Hse/Fam #405 Conley, James R W M 29 Laborer Married NC NC NC [b abt 1851] Conley, Nancy E W F 24 Wife Keeping House Married TN TN NC [abt 1856] Conley, Mary A W F 5 Dau Single TX NC TN [abt 1875] Conley, Stephen L W M 4 Son Single TX NC TN [abt 1876] Conley, Jason M W M 2 Son TX NC TN [b abt 1878] Conley, James E W M 1 Son TX NC TN [b abt 1879] Condra, Lucy J W F 14 Servant Single TX TN NC Cannot write [b abt 1866] 1880 Federal Census, Grayson County, Texas, 1 July, Whitesboro, District 7, page 44, Hse/Fam #406 Winter, William T W M 28 Laborer Married MS TN TN [b abt 1852] Winter, Mary J W F 24 Wife Keeping House Married AR TN TN [abt 1856] Conrad, Robert L W M 3 Son Single TX AR TN [abt 1877] Conrad, William C W M 1 Son Single TX AR TN [abt 1879] Riddle, McMurry W M 24 Brother-in-law Had typhoid fever AR TN TN [b abt 1866] Riddle, Rufus L A W M 12 Brother-in-law Single AR TN TN [b abt 1868] 1880 Federal Census, Grayson County, Texas, 1 July, Whitesboro, District 7, page 44, Hse/Fam #407 Winter, Stephen W M 60 Laborer Married TN NC NC [b abt 1820] Winter, Ellen W F 55 Wife Keeping House Married AL VA TN [abt 1825] Conrad, Lucy B W F 25 Stepdaughter Single AR TN AL [abt 1855] Conrad, Lula P W F 4 Stepgranddau TX IN AR [abt 1876] Yeary, Lervy (Larry?) Etta Lillie Pickett -- Pam Smith, email to Orville Boyd Jenkins, 08 August 2013 ----------------------- The first record I have found for Nelson is the 1860 census, when he is reported as 3 years old, in Cass County, Texas. 1860 Federal Census, Cass County, Texas, 16 October, Precinct 3, PO Unionville and Cusseta, p 64, Hse #434, Fam #444 W B Winter 37 M Farmer $150 Personal Estate b Alabama (b abt 1823) L Winter 30 F b Tennessee (b abt 1830) -- page 65 -- N Winter 3 M b Texas In the 1870 and 1880 censuses, the family name is listed as Winter. In 1870 they are living in Davis County, east Texas. 1870 Federal Census, Davis County, Texas, 17 August, Precinct 3, PO Cussetta, page 39, Hse/Fam #316 Winter, Wily 48 M W Farmer $500 Real Estate $500 Personal born Alabama Attended School this year (?) Winter, Lucinda 40 F W b Tennessee Attended School this year (?) Winter, Nelson 14 M W born Texas Attended School this year In this census, note that the enumerator's report indicates that not only Nelson (and all his siblings), but even the parents, attended school. Nelson is farming in a household with his widowed mother in Montague County, Texas (in East Texas near the Red River). The initial of his mother here is S, but her reported name in 1870 was Lucinda. There is an outside possibility that the initial in the 1880 census is an L. But more likely her name was Lucinda S. 1880 Federal Census, Montague County, Texas, 8 June, Precinct 2, District 120, page 3, Hse/Hse #17 Winter, S W F 48 Mother Widow Keeping House TN TN TN [born abt 1832] Winter, N H W M 23 Son Single Farmer TX AL TN [born abt 1857] In 1900 Nelson has married Margaret (spelled Margurette by the family) Cassandra Jenkins. They are in Chickasaw Nation of Indian Territory, with three children. From the birth of the oldest child here, we can estimate they married about 1886 In Texas. 1900 Federal Census, Chickasaw Nation, Indian Territory, 13 June, Township 3, District 132, page 6A, Hse/Fam #93 Winter, Nelson H Head W M Jan 1857 43 TX Unknown Unknown Farmer Winter, Margare[t] Wife W F Jan 1864 36 TX MS MS Winter, Sydney S Son W M Jan 1887 13 Ind Terr TX TX Winter, Edna Daughter W F Aug 1889 10 Ind Terr TX TX Winter, Claudie Son W M Oct 1892 7 Ind Terr TX TX Note that this census, like 1910, shows both Margaret's parents born in Mississippi, though Joseph was born in South Carolina. In the 1920 census, it appears the enumerator has simply copied the birthplace information from Nelson for Margaret. The T is not visible on her name, because of a faded spot that also blots out the top of the S in Sydney's middle initial. Compare the birth date reported here for Claude (Claudie) with the ages in 1910 and 1920, which would mean he was born in 1894 (if birthday was in October). 1910 Federal Census, Colorado County, Texas, 9 May, Precinct 2, District 21, page 10B, Hse #204, Fam #207 Winters, Nelson H Head M W 54 Married 30yrs TX AL TN Farming Rents Winters, Catherine E Wife F W 48 Married 30yrs 5 children/5 living TX MS MS Winters, Claude C F W 15 OK TX TX Farm Laborer In the 1920 census, the family name is written as Winter. 1920 Federal Census, Harris County, Texas, 20 January, Justice Precinct 8, District 123, page 6B, Hse# 136, Fam #141 Winter, Nelson H Head M W 63 TX AL TN Farmer Winter, Margaret C Wife F W 57 TX AL TN Winter, Sid S Son M W 34 OK TX TX Farm Laborer Winter, Claude C Son M W 25 OK TX TX Farm Laborer Winter, Zora Daughter-in-law F W 26 KY KY KY Winter, Etta L Daughter-in-law F W 25 TX AL TX Winter, Zenith C Grand Daughter F W 11 TX OK KY Winter, Zela Grand Daughter F W 11 TX OK KY Winter, Clotilda C Grand Daughter F W 3mos TX OK TX [b abt October 1919] The enumerator does not list the sons and their wives in family order, as I normally see in the censuses. From the birth places of the children, though, it seems possible to reconstruct who the grandchildren belong to. It appears that Zenith and Zela are children of Zora, while Clotilda is the daughter of Etta. In the 1930 we get some clarification because Sid is enumerated with his wife Zora (Ancestry transcribes it Zera) and his daughter Zenith. --------------------- Nelson Haney "Nell" Winter Birth Jan 1857, USA Death Apr. 7, 1927 Harris County, Texas, USA Nelson "Nell" Haney Winter was the son of Wiley/Wylie B.
