First Washburn to open a store on old Lincoln-Rutherford highway. Also a Washburn Tavern. Benjamin elected to the state legislature in 1858. Justice of the Peace, County Coroner, County Trustee and County Treasurer. Shot from ambush by former inmate of the insane asylum.
Benjamin and Delphia had three children: Elizabeth, Perry Bryant and a child who died in infancy.
Benjamin and Mary had four children: Mary Rebecca, John Rutherford, Telitha and a daughter who died in infancy.

Wednesday, March 25, 1863
Murder - Mr Benjamin Washburn, an old and respectable citizen of Rutherford County, NC, was brutally murdered in cold blood by the hand of one George Suttles, on the 5th last. The wound was inflected [sic] by a pistol, and produced death instantly. Mr Washburn was about 50 years of age, and had filed [sic] important positions in his county. Suttles has been arrested.
